EXCLUSION OF LIABILITY ASSUMPTION OF RISK, JURISDICTION

As a condition of participation in the Wainwright Stampede Parade, I the Participant assume all risk of personal injury, death, or property loss resulting from any cause whatsoever including but not limited to the negligence, breach of contact, or breach of statutory duty of care on the part of the Town of Wainwright, the Wainwright Frontier & Exhibition Agricultural Society and their Directors, Officers, Volunteers, Employees, Agents, Representative, or Sponsors (hereinafter collectively referred to as the “Parade Operators”).  The Participant agrees that the Parade Operators shall not be liable for any such personal injury, death, or property loss however caused and releases the Parade Operators and waives all claims with respect thereto.  The Participant agrees that any litigation involving the Parade Operators shall be brought solely within the Province of Alberta and shall be within the exclusive jurisdiction of the Courts of the Province of Alberta.  The Participant furthers agrees that these conditions and any rights, duties, obligations as between the Parade Operators and the Participant shall be governed by the interpreted solely in accordance with the laws of the Province of Alberta and no other jurisdiction.

HOLDING HARMLESS AND INDEMNITY CLAUSE

That by signing this Agreement and participating in the Wainwright Stampede Parade, I further agree I will save harmless and indemnify the Town of Wainwright, The Wainwright Frontier & Exhibition Agricultural Society and their Directors, Officers, Volunteers, Employees, Agents, Representatives, or Sponsors, from any and all liabilities and claims which may occur from my participating in the Wainwright Stampede Parade, however caused.
